LEGAL REGULATION OF STANDARDIZATION: STRENGTHENING OF MARKET SUPERVISION AND COMMODITY EVALUATION

Abstract

Ukraine confirmed the priority of the vector to harmonize the legal regulation of standardization with the norms of the European Union by signing the Association Agreement between Ukraine and the EU. However, there is still a need to strengthen market supervision in this area. The article is devoted to the analysis of the legal regulation of standardization in Ukraine. It defines the main effects of the approximation of norms of standardization of goods in Ukraine to world norms (economic, social, technological). It was established that the mechanism of the functioning of the domestic quality infrastructure was gradually reassessed, as a result of which the simultaneous functioning of both state and private institutions was approved. The areas of implementation of the new EU standardization strategy are considered. It is noted that safety, environmental friendliness and digitalization are key parameters of the commodity evaluation of quality standards. The system of standardization operating in Ukraine (principles, tasks, bodies of the state standardization service, regulatory documents on standardization) has been studied. It has a number of positive components that should be strengthened and combined with the most successful European practices. Many decisive steps in this direction have already been taken. The normative and legal acts adopted and updated in Ukraine, which not only regulate relations in the sphere of standardization of goods and services, but also aim to bring the norms of Ukrainian legislation in this field closer to European ones, have been reviewed. The advantages of the future signing of the AСAA agreement by Ukraine and the EU are also formulated. Attention is focused on the key features of the introduction and strengthening of market supervision in the field of standardization, among which it is worth emphasizing the increase of the intervention of interested parties and the strengthening of responsibility for violations of quality standards. Among the functions of market surveillance, it is worth emphasizing the following: monitoring products on the market and responding to customer complaints; procurement of goods on the market using the "mystery shopper" method using budget funds; testing of goods for compliance with technical regulations in accredited laboratories; facilitating the imposition of fines on manufacturers or those responsible for importing products that do not meet standards; facilitating the withdrawal of products from the market if they do not meet standards.
